Senior Regulatory Counsel
The American Public Power Association (APPA) is looking for a Senior Regulatory Counsel to assist in formulating APPA's energy and other regulatory policy positions to develop and execute strategies to advance those positions.
Advocates on behalf of APPA before the Federal Energy Regulatory Commission (FERC), other regulatory agencies, federal courts, and other industry and policy forums.
Monitors agency and judicial proceedings and industry forums of interest to APPA and its members.
Identifies opportunities to assemble and participates in coalitions on such matters with other industry associations and groups as appropriate.
Communicates with APPA utility members, groups of members, and their counsel to develop and coordinate consistent policy positions.
Coordinates with APPA Integrated Media and Communications (IMC) staff to publicize and promote Association positions.

Candidates must be in the DC, Maryland, and Virginia area.
APPA offers a flexible work schedule for full-time employees, and the option for telework is available after 3 months of employment (with supervisor approval).
In conjunction with the Senior VP of positions and communications and General Counsel, assists in formulating APPA's regulatory policy positions, and develops and executes strategies to advance those positions.
Provides strategic and tactical advice to Senior VP of Advocacy & Communications and General Counsel.
Prepares pleadings, comments, briefs, and testimony on behalf of APPA for filing with FERC, other regulatory agencies, and the North American Electric Reliability Corporation (NERC) as appropriate and necessary.
Manages Director, Policy Analysis & Reliability Standards to gather member input on NERC proposals and to ensure public power's views are shared with NERC.
Represents APPA before FERC and other regulatory agencies through appearances in selected proceedings, at technical conferences, and in personal meetings as appropriate and necessary.
Represents APPA through speeches and presentations to government agencies, member and industry groups, and other organizations and coalitions as appropriate.
Represents APPA before federal courts as a party or amicus curiae; drafts pleadings and briefs for filing with courts as appropriate and necessary.
Coordinates with APPA members and other industry coalitions, associations, and groups in agency and court litigation as appropriate and necessary.
Seeks and creates opportunities to advocate APPA policies and objectives.
Monitors selected legal developments, pending cases, and court decisions of significance to APPA in areas of responsibility.
Analyzes legislation in areas of expertise and responsibility; assists Government Relations staff as appropriate and necessary.
Assists in the development of programming for and management of APPA Legal Seminar in conjunction with General Counsel and Meetings staff.
Schedules, organizes, and leads APPA's annual meeting of member FERC counsel.
Works with IMC staff to promote and publicize APPA positions and matters of interest to the public power community, including through direct interaction with members of the media, publication of articles and blogs, appropriate use of social media, identifying topics for Public Power Current, and reviewing and editing stories.
Provides legal advice and analysis to support policy advocacy of other APPA departments and personnel.
Assists APPA members with specific legal matters relating to areas of expertise, such as providing information and referrals, without providing legal representation to members.
Apprises APPA members of selected legal developments through listserv updates, postings, and other communications as necessary and appropriate.
Works with APPA utility members and their counsel to develop association policy priorities and policy positions with respect to FERC and other regulatory matters.
Supervises activities of outside counsel in regulatory matters in conjunction with General Counsel.
Attends National Association of Regulatory Utility Commissioner (NARUC) meetings and interfaces with members of NARUC Committees, NARUC staff, and other meeting attendees.
Seeks opportunities to participate, including taking leadership roles, in professional associations to increase the visibility of the Association for the benefit of its members.
Law degree and appropriate bar admissions to practice law before state and federal courts.
At least 10 years of law practice in energy regulatory law.
Substantial and relevant experience in FERC and NERC regulatory matters.
Broad experience in electricity policy issues, including wholesale markets, transmission, and regional transmission organizations.
Specific experience representing the interests of public power utilities, and familiarity with legal and regulatory issues particular to public power utilities.
Experience with judicial review of FERC or other administrative agency orders.
Ability to advocate effectively APPA policies and positions and pursue opportunities to advance Association views and objectives.
Ability to analyze legal issues, draft complex legal documents, understand multifaceted regulatory, technical, and economic issues and develop solutions.
Ability to manage complex administrative and appellate litigation and supervise outside counsel.
Ability to help plan and organize APPA educational offerings in areas of expertise.
Ability to communicate effectively, orally and in writing, and gain cooperation from staff, members, outside counsel, other industry association representatives, press, and the public.
